Which Personal Information do we collect from you?

H&F collects the following categories of Personal Information:

  • Other information that you voluntarily enter on the Website’s contact form.

Certain state laws deem IP addresses as Personal Information. As mentioned under (ii) of the Section “How do we collect your Personal Information?”, the IP addresses that we collect are anonymized.

How do we collect your Personal Information?

i. Personal Information directly provided by you

We obtain or receive Personal Information directly from you if you fill out our contact form on the Website (i.e., as part of your correspondence with us).

ii. Personal Information we receive indirectly (through automatic data collection tools)

We may use Cookies (as defined below) and automatic data collection technologies to collect certain information about you. For more information on cookies, please see “2. Cookies” below. However, all such information (including but not limited to IP addresses) is anonymized and de-identified.

Some internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” or similar signals.

For which purposes do we collect your Personal Information?

H&F processes information we collect from you on the Website (including Personal Information) for the following purposes:

  • Customer service, communication purposes. For the performance of customer service and to respond to your inquiries or requests;
  • Quality and management purposes. To monitor, improve and analyze the quality and use of our Website, services, processes, and systems; to inform our management and perform internal reviews; and
  • Legislation and regulation. To identify and counter fraud, perform audits, ensure safety within H&F and comply with orders of a court, law enforcement, government authorities, applicable laws, rules, and regulations.

To whom do we disclose your Personal Information?

H&F does not disclose your Personal Information to third parties. Note that the companies in the H&F group may disclose Personal Information to each other and process such disclosed Personal Information.

However, we may disclose your Personal Information, if we believe doing so is required or appropriate: (i) to comply with federal, state, or local laws, or comply with a court order or subpoena to provide information; (ii) to comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities; (iii) to cooperate with law enforcement agencies concerning conduct or activity that the business, service provider, or third party reasonably and in good faith believes may violate federal, state, or local law; (iv) to cooperate with a government agency request for emergency access to a consumer’s personal information if a natural person is at risk or danger of death or serious physical injury, (v) to exercise or defend legal claims; (vi) to respond to your requests; (vii) to protect yours, ours or others’ rights, property or safety; (viii) to enforce H&F policies or contracts; (ix) to collect amounts owed to H&F; (x) to comply with records retention policies, if any; (xi) when we believe access, preservation, or disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation or prosecution of suspected or actual illegal activity; or (xii) if we, in good faith, believe that access, preservation, or disclosure is otherwise necessary or advisable.

We have not sold Personal Information in the past 12 months for monetary consideration and do not intend to do so.

How do we protect your Personal Information?

We have implemented both technical and organizational measures designed to protect your Personal Information against accidental loss, theft and unauthorized access. Examples are the use of firewalls and encryption.

We strive to continually improve our security measures in case of technological advances and developments. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to the Website or to us via electronic communication. How long does H&F store/retain your Personal Information?

We will delete or de-identify your Personal Information when your Personal Information is no longer necessary for such purpose. But we may also need to store your Personal Information to fulfill a legal obligation or to resolve disputes.

Matomo collects information from you about your visit and use of our Website and the device and browser that you used. It creates a pseudonymized user profile using the collected information. These profiles do not contain nor are they combined with Personal Information. 3. Rights regarding your Personal Information

Every user of our Website may request (i) information on the Personal Information we collect from them, (ii) access to an overview of such Personal Information, (iii) correction or deletion of their Personal Information, and (iv) to receive the requested information on their Personal Information in a portable manner. You can make any of the foregoing requests by contacting us using the contact information under Section 6 below.

We will respond to your request related to Personal Information only if we can verify your identity or your authority to make the request, and if we can confirm that the Personal Information relates to you or the person on whose behalf you are submitting the request.

You do not need to create an account with us to submit a request related to your Personal Information.

Please be informed that if you make certain requests (e.g., request to delete Personal Information), we may no longer be able to offer you the use of the Website or portions thereof. You may also lose access to the Personal Information in your account. We are not under any obligation to maintain a back-up of your Personal Information.

4. Response Time                                                                      

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at usa@herbstreith-fox.com.

We endeavor to respond to the substance of your verified consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding receipt of your request. Upon your request, unless it is impossible or involves disproportionate effort, we will also provide you with disclosures beyond the 12-month period for Personal Information. If we cannot comply with your request, the response we provide will also explain the reasons why. We will provide your Personal Information in a format that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

You may only submit a request to know once within a 12-month period unless the applicable section in the State-Specific Notice states otherwise.

We do not charge a fee to process or respond to your verifiable consumer request unless your request is without basis or excessive, in particular, if we have received repeated similar requests from you. If we determine that the request warrants charging a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

5. Non-discrimination Policy

We will not discriminate against you for exercising any of your rights pursuant to this Privacy Policy or the State-Specific Notice. Unless permitted by applicable law, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of goods or services; or
